THE HINDU SON CAN DIVORCE HIS WIFE IF SHE TRIES TO SEPARATE HIM FROM HIS AGED PARENTS

Title of the Case- The husband can divorce his wife if she tries to separate him from his aged parents.

In Hinduism, there is a strong emphasis on the importance of family and filial piety, including the duty of children to respect and care for their aging parents. Therefore, if a wife were to attempt to separate her husband from his parents, it could be viewed as a serious breach of this duty and may constitute grounds for divorce under certain circumstances.

Justice Dave wrote in his Judgment that it is important to respect and care for one’s parents, particularly as they age and may require additional support and assistance. Therefore, if wife tries to interfere with the relationship between the husband and their aging parents, it can be viewed as a serious breach of marital duty and may constitute grounds for divorce.

Bench stressed that In Hindu law, there are several grounds for divorce, including cruelty, adultery, and desertion, among others. However, the law also recognizes that a spouse’s failure to fulfill their duty to care for their parents can be grounds for divorce. This is based on the belief that it is the duty of children to provide emotional, physical, and financial support to their aging parents.
